Des Moines Police — March 29-31
March 29, 8:44 p.m.
Assault with a weapon in the
1400 block of East 29th Street.
Officers were dispatched on a
call about an assault with a weapon.
Upon arrival, they met with the
victim who stated he was riding
his bike to a nearby gas station
when he believed he was being
shot at with a BB gun. He stated
that he could hear the BBs going
by his head. He noticed a silver
four-door car with four males
inside following him. When he
left the gas station and started
to head home, the victim saw the
same car turn around and drive
towards him. He reported seeing
the rear passenger stick a BB
gun out of the window and shoot
at him. The victim was allegedly
struck on the back near his right
shoulder. Pictures were taken
of his injuries but he declined
medical attention.
March 30, 3:30 p.m.
Burglary in the 1300 block of
East Oak Park Avenue. The victim
stated she was at home painting
when there was a knock at the
door asking for Lynette. The victim
said she opened the door and told
a hispanic male that Lynette did
not live there anymore. At that
time, two more hispanic males
appeared and all three pushed
their way into the house knocking
the victim to the ground. All
three men reportedly had guns
and told the victim they were
there because a man named “Angel”
had stolen drugs from them and
this was the house where he kept
them. They ransacked the house,
but found nothing. One of the
men tore the necklace off the
victim’s neck, took money from
her pockets ($5) and her cell
phone.
March 31, 2:15 a.m.
Burglary in the 3700 block of
East 14th Street. Officers were
dispatched to Dahl’s Foods, 1320
E. Euclid Ave., on a car prowler
call, but before they reached
the scene, were flagged down by
an unknown UPS semi-driver. The
driver stated he observed three
men break into the Family Dollar
Store, 1306 E. 14th St., and enter
the business. Officers were on
the scene in seconds but there
was no sign of the suspects. The
glass of the front door was broken
and while officers waited for
management to arrive, they observed
three males fitting the description
walking down the street. All three
were apprehended and charged with
third degree burglary.
BUSTED

Name: Ralph Dovey
The story: A man, later identified
as Ralph Dovey, was walking past
the counter of Fredericks Coffee,
655 Walnut St., when he reached
over and grabbed a raspberry scone
and tried to leave. An employee
caught Dovey and told officers
they have had trouble with him
in the past. Dovey was arrested
without incident and was taken
to the Polk County Jail. The raspberry
scone was returned to Fredericks.
DOCKET DIVING
The following is from a recent
ruling made by the Iowa Court
of Appeals regarding the case
of the State of Iowa vs. Dorsey
Dwight Wilson.
“On Dec. 15, 2006, Des Moines
police officer Tim Fricke stopped
a vehicle because it did not have
a rear license plate. Dorsey Wilson
was the only passenger in the
car. When Officer Fricke asked
Wilson to get out of the car,
he noticed a corner of a baggie,
which Officer Fricke knew was
consistent with baggies that were
used for carrying illegal drugs.
Underneath the front passenger
seat Officer Fricke found loose
marijuana on top of a CD jacket.
When Wilson was asked if there
were more drugs in the vehicle,
he stated there was more in the
cup holder on the passenger side
of the vehicle. The officers found
a baggie of marijuana in a cup
holder. Officer Fricke also found
cigarillos on the center console
of the vehicle. He stated drug
users sometimes removed the tobacco
from a cigarillo or cigar and
filled it with marijuana. Wilson
was charged with possession of
a controlled substance (marijuana),
second offense.
“At the trial his sister, Mary
Wilson, testified the marijuana
belonged to her. She stated she
placed some in a flyer, and threw
it on the floor under the seat.
She also stated she placed some
in the backseat ashtray. The jury
returned a verdict finding Wilson
guilty of possession of marijuana.
He was sentenced to sixty days
in the county jail, to be served
consecutively to another sentence.
Wilson appeals, claiming there
is insufficient evidence to support
his conviction. Wilson contends
there is insufficient evidence
in the record to show he had constructive
possession of the marijuana. He
asserts there is not sufficient
evidence to show he had knowledge
of the marijuana, let alone that
he exercised dominion and control
over the illegal drugs. He states
he was merely the passenger in
the car where marijuana happened
to be present.
“Looking at the evidence as
a whole, we find there is substantial
evidence in the record to support
Wilson’s conviction for possession
of marijuana. Wilson’s conviction
is not based merely on the fact
that marijuana was found in a
car where he was a passenger.
We affirm Wilson’s conviction.”
