Des Moines Police — May 7
5:05 a.m.
Burglary at Kenny D’s, 3925 E.
14th St. Des Moines Police arrived
at Kenny D’s and met with its
manager, who stated that someone
broke into the bar by throwing
a rock through the front window.
Once inside, the suspect(s) pried
open two electronic games and
stole approximately $400 in cash
found within the machines. The
crow bar used to open the machines
was left behind. While breaking
and entering the suspect(s) cut
themselves, leaving a trail of
blood inside the bar. The suspect(s)
exited through the bar’s north
door, which was found unlocked.
9:32 a.m.
Arson investigation at East High
School, 815 E. 13th St. Investigators
from the fire and police departments
were called to assist with a trashcan
fire that occurred in a fourth
floor girls restroom. The fire
was discovered by a teacher, who
helped extinguish the fire. The
fire occurred during passing time.
Police had no suspects at the
time of the report.
5:45 p.m.
Assault causing injury in the
500 block of 15th Street. Two
residents of an apartment building
were allegedly attacked by their
apartment manager. The altercation
between the manager and residents
stemmed from a civil dispute involving
a van the manager sold or gave
to the residents. One of the residents
(victim #1, a male) was leaving
the apartment building when the
manager, described as a white
female, approached him, screaming,
“Give me my money,” and then punched
him in the chest and back. The
resident reportedly left the scene
without any injuries. The other
resident (victim #2, a female)
reported that the manager forced
her way into her apartment unit
and demanded money from her. The
resident later changed her story,
saying the manager did not force
her way in but did assault her,
giving her a bloody nose. At the
time of the report, police were
unable to locate the apartment
manager.
Busted
Name: Carol Ann Bloodsworth
The story: Des Moines Police arrested
Bloodsworth on May 6 for allegedly
stealing what amounted to $836
worth of merchandise from Younkers
located at Southridge Mall (1111
E. Army Post Rd.). According to
the police report, Bloodsworth
was spotted removing the packaging
and tags from unpaid merchandise
and concealing the items under
her coat and inside her purse.
Bloodsworth then walked past all
points of sale and out the store’s
east door, where she was arrested
and transported to Polk County
Jail in “the wagon.”

Docket Diving
From the Iowa Supreme Court’s
ruling in the case of Brian L.
Evans vs. Judy Benson and Bluffs
Psychiatric Associates:
“Brian Evans sued Judy Benson,
a nurse, and her employer, Bluffs
Psychiatric Associates, P.C.,
for invasion of privacy and negligent
disclosure of confidential medical
records. The case was tried by
the court without a jury, and
the court entered findings of
fact and judgment in favor of
the defendants. We affirm.
The plaintiff, Brian Evans,
had been employed by Pella Corporation
in its Shenandoah plant, but his
employment was terminated as the
result of several problems experienced
in that relationship. He had been
reprimanded for excessive absenteeism
and was warned of possible termination
if his performance did not improve.
These disciplinary matters were
handled by Robert Larson, Pella’s
human resources manager. Evans
expressed hostility toward Larson
and admitted he had homicidal
thoughts about him. At the urging
of Evans’ fiancée, he was
evaluated by a clinical psychologist
in November 2000, and the psychologist
reported that Evans was highly
irritable, had suicidal thoughts,
and confirmed that Evans had homicidal
thoughts about Larson. Later in
November, Evans was evaluated
by defendant Judy Benson, a registered
nurse practitioner, who testified
that Evans had exhibited signs
of anxiety and suicidal thoughts.
He also talked about Robert Larson
and hurting him ‘real bad.’ Benson
told Evans that she thought it
was her professional responsibility
to warn Larson of the danger posed
by Evans. …
… Benson testified that Evans
was experiencing “command hallucinations”
— voices that told him what to
do — and a voice told him to harm
himself. He stated he had access
to a gun, and Benson was ‘very,
very worried’ about what might
happen. … On Nov. 30, 2000, the
day Evans was examined by Benson,
Benson called Robert Larson to
inform him of her concerns for
his safety. That call, according
to Evans, caused [his] employment
to be terminated.”
The district court disagreed
with Evans, noting that at the
time of his firing, his absenteeism
rate was at 23 percent and that
he failed to respond to earlier
corrective actions by Pella —
proving that regardless of Benson’s
phone call, Evans would have been
terminated.
