Des Moines Police Sept. 19-21

 

Sept. 19, 9:20 p.m.

Robbery in the 2400 block of Hickman Road. While an officer was working off duty, the victim, who stated he delivered for Pizza Hut, approached the officer and told him he was robbed while making a delivery. The victim said the apartment number did not exist, but two skinny built black males told him they were the ones that ordered the pizza. They told the victim the money was upstairs and as the three headed up the stairs, the two suspects pushed the victim, knocking him back. They grabbed the pizza and tried to grab the victim’s wallet, but a struggled ensued, and the suspects fled the scene. Officers searched the area, but could not locate the suspects. There are no witnesses at this time.

 

Sept. 20, 3 to 11 a.m.

Burglary in the 2900 block of Cottage Grove Avenue. The victim stated he came home around 3 a.m. and went to sleep. When he woke up the next morning, he noticed the window to his apartment had been broken out and the screen was cut. The victim was in the process of moving, and most of his stuff already boxed up. He did notice that two Xbox 360 games, six DVDs and $80 were missing. There are no witnesses or suspects at this time.

 

Sept. 21, 2:45 p.m.

Assault in the 4000 block of East Ovid Avenue. Officers spoke with the victim, who stated she had been feuding with another girl at her middle school over a boy the victim dated last year. The victim stated that the suspect approached her in school and began taunting her, saying she was going to beat her up last year but didn’t get the chance to. The victim stated that as she was walking home with her sister, the suspect along with two other girls started following them. The victim said the girls caught up to them, and the suspect pushed her. The victim ignored her and kept walking. The girls approached again, and the suspect pushed the victim, knocking her to the ground. The victim stood up, and a fight ensued. The victim stated that one of the girls with the suspect recorded the fight on her phone.

 

 

Busted

Name: LisaAnn Marie McCloskey

The story: Officers were dispatched to Git-N-Go, 890 County Line Road, on a robbery report. Upon arrival, the clerk informed officers that the suspect, later identified as LisaAnn Marie McClosky, had just fled the scene, heading eastbound in a maroon colored car. Officers located the vehicle and performed a routine stop. Officers asked McCloskey if she had any idea what was going on, and she said, “Yes, I just robbed the Git-N-Go.” The clerk told the officers that the suspect had a gun, but McCloskey told officers, “I had a pocketknife under my shirt and pointed it like a gun.” A black pocketknife was located on McCloskey, along with an unknown amount of cash bills. The clerk identified McCloskey as the suspect. She was charged with first degree robbery and taken to the Polk County Jail.

 

Docket diving

The following is from a recent ruling made by the Iowa Court of Appeals regarding the case of the State of Iowa vs. Kyle Gavin Troge.


“On June 14, 2008, a Bremer County Deputy Sheriff began following a pickup truck in Waverly, Iowa. He saw the pickup drift about three times within its own lane of traffic and then turned on the video camera in his patrol car. The deputy testified the pickup drifted four or five distinct times after he turned on his video recorder. Soon after the deputy observed the pickup move from the left lane to the right lane, and the driver did not signal the lane change until the vehicle was halfway into the right lane. The deputy stated the failure to signal affected his decision to stop the vehicle. The deputy initiated a traffic stop. The driver of the vehicle was Kyle Troge. Troge failed a field sobriety test and submitted to a preliminary breath test, which revealed his blood alcohol level was over the legal limit. Troge was arrested for operating while intoxicated.

“Troge submitted to chemical testing and was determined to have blood alcohol level of .093. The State subsequently charged Troge with operating while intoxicated, second offense. Troge filed a motion to suppress claiming the deputy did not have probable cause to stop his vehicle. The district court denied the motion. The court found Troge guilty of operating while intoxicated, second offense. Troge appeals the district court’s ruling on his motion to suppress.

“The videotape does not support the assertion that the pickup drifted four or five distinct times. Troge’s vehicle never crossed the centerlines, and the videotape does not reveal any violations of the rules of the road. We do not believe an objective person watching the videotape for the first time would have a reasonable suspicion that the driver of the pickup was under the influence.

“We determine the facts available to the officer at the moment of the stop would not ‘warrant a man of reasonable caution in the belief’ that the action taken was appropriate. Because we find the deputy did not have reasonable suspicion to stop the vehicle, we reverse the decision of the district court denying Troge’s motion to suppress. We reverse Troge’s conviction and remand the case to the district court for further proceedings not inconsistent with this opinion.”
