Des Moines Police Aug. 31 - Sept. 1

 

Aug. 31, 6:28 p.m.

Assault in the 1300 block of 13th Street. Upon arrival, officers spoke with the victim, who works at Creative Visions, 1343 13th St. She stated that two black female suspects started arguing with her daughter outside the building. The victim and another employee went outside to see what was going on. The suspects, who were mother and daughter, wanted to fight the victim’s daughter. The victim told her daughter to go inside and call the police. The suspects started fighting with the victim and the other employee, using their belts to swing at them. Soon after the confrontation, the suspects fled the scene.

 

Aug. 31, 6:30 p.m.

Assault in the 300 block of East McKinley Avenue. Officers spoke with the victim, who stated she was at an apartment building trying to get her boyfriend to leave when the suspect, a black female, told her to leave. The victim started to leave and the suspect followed her downstairs, holding a sock with something heavy inside it. The suspect then got into the victim’s vehicle and tried to move it. The victim reached to pull the keys out, but the suspect hit her on the head with the sock. The victim fell back and to the ground. Then the suspect, along with another unknown suspect, started to punch and kick the victim. After the suspects fled the scene, the victim drove herself to the hospital. No witness at this time.

 

Sept. 1, 4:45 a.m.

Robbery in the 1400 block of 22nd Street. Officers were dispatched to a dispute call between a customer and a cab driver. The cab driver told police that the suspect called for a cab to pick him up in the 1300 block of 12th Street. The suspect asked the driver if he could break a $100, and the driver said “no.” The driver stated the suspect went inside the apartment complex and came out shortly after with a crumpled up bill he claimed was a $50. The bill was so crumpled the driver told the suspect he wasn’t giving him change until he saw the bill. The suspect then punched the driver, grabbed the $40 in change he was holding and fled the scene. There are no witnesses at this time.

 

Busted

Name: James Mitchell Oliver

The story: The suspect, later identified as James Mitchell Oliver, was seen exposing his penis and testicles to three different women at Johnny Mac’s Sports Bar and Grill, 2219 Hubbell Ave. Oliver was standing outside the back door entrance and exposing himself when patrons walked out. Officers observed that Oliver had been drinking, and he admitted to officers he was on federal parole. Oliver was taken into custody without incident and charged with indecent exposure.

 

Docket diving

The following is from a recent ruling made by the Iowa Court of Appeals regarding the case of the State of Iowa vs. Ronnie O’Neal Shivers.

“At the time the present offenses were committed on May 18, 2007, Shivers was on already on probation for drug-related offenses he committed in 2006. While the present case was pending, Shivers’ probation was revoked, and he was committed to prison for a term not to exceed twelve years. Shivers was in prison serving that sentence when the sentencing hearing in the present case was held. At the sentencing hearing on Sept. 19, 2008, the State asked that concurrent five-year sentences be imposed on the present charges, but urged the sentencing court to run Shivers’ sentences consecutive to the 12-year sentence he was already serving. The State cited Shivers’ extensive criminal history and the fact that the new charges were committed while he was on probation. Shivers argued that since he was already serving a 12-year sentence, his sentences in this case should run concurrently with that sentence. He argued that adding additional time to the 12-year sentence would not aid in his rehabilitation.

“After considering the arguments of counsel, the court ordered Shivers to serve a term of imprisonment not to exceed five years on each charge, to be served concurrently. The court further ordered these sentences were to be served consecutively to any sentences previously imposed. The district court did not give any reasons for its sentence during the sentencing hearing. However, the written sentencing order filed immediately after Shivers was sentenced stated, ‘Due to the Defendant’s lengthy criminal record and his current incarceration on other charges, this Court concludes that judgment should be imposed as hereinafter provided.’

“At the sentencing hearing, the State and Shivers agreed on all but one detail regarding Shivers’ sentence. Shivers’ attorney acknowledged that ‘street probation doesn’t seem viable’ and agreed with the State’s recommendation to run the two five-year terms for his client’s present convictions concurrently. The record reveals the only difference between the recommendations from counsel for the State and Shivers counsel was whether Shivers’ two five year terms would be served concurrently with or consecutively to his prior 12-year sentence. Accordingly, we affirm the court’s sentencing order.”
